Additional Real-Estate Salesperson Legislature

License Requirements

A real estate salesperson is licensed to assist a licensed real estate broker in performing any of the duties associated with real estate transactions, including selling, buying, and leasing properties. To obtain a real estate salesperson license in New York, applicants must meet the following requirements:

• Be at least 18 years old.

• Successfully complete a 75-hour salesperson qualifying education course approved by the Department of State.

• Pass the New York State real estate salesperson examination.

• Be sponsored by a licensed New York State real estate broker.

• Submit a completed application and the required fee to the Department of State.

Continuing Education

Licensed real estate salespersons are required to complete continuing education to renew their licenses every two years. The continuing education requirement includes:

• 22.5 hours of approved continuing education courses, including at least 3 hours of fair housing and discrimination training.

• Completion of other mandatory topics as prescribed by the Department of State.

Responsibilities and Duties

Third-Party Endorsements and Liability

Third-party real estate agents and brokers may endorse their compliance with OMNI standards and contract wholesaling processes but are not liable in any way for OMNI's services or any entities.

Your Responsibilities:

You shall comply with all applicable local, state, national, and international laws, treaties, regulations, and conventions in connection with your use of the Website and OMNI Service, including, without limitation, those pertaining to data privacy, international communications, and the exportation of technical or personal data from jurisdictions other than the one from which OMNI operates the Website and its associated services. Additionally, you expressly agree not to infringe upon any person's rights of publicity or privacy, nor to defame any person or entity. You are responsible for maintaining accurate account information at all times, including a valid email address. You are also responsible for keeping your email address, passwords, account numbers, and other account information confidential. OMNI is entitled to act on instructions received under your username and password. OMNI shall not be liable for any credits or debits made to your account by an unauthorized user who uses your password. OMNI is not responsible for any losses or liabilities incurred through the unauthorized use of your password by a third party. You authorize OMNI to disclose to third parties the information you have provided or information that OMNI has obtained about your OMNI account, as further detailed in our Privacy Policy.

Indemnities:

You hereby agree to defend, indemnify, and hold OMNI harmless from and against any and all claims, costs, damages, losses, liabilities, and expenses, including but not limited to attorneys’ fees and costs, arising out of or in connection with any third-party claim related to your use of the Website and the OMNI Service; the indemnification also includes claims arising from user breaches of the Terms, misuse of the service, and violations of law. This Limitation of Liability clause limits the company's liability for damages, except where prohibited by law.
